Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you and CADasBuilt/Anais Graphic Services (“CADasBuilt”), regarding your access to and use of the [cadasbuilt.com] website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “CADasBuilt Site”).

You agree that by accessing the CADasBuilt Site, agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are explicitly prohibited from using the CADasBuilt Site and you must terminate use immediately.

Supplemental Terms of Use or documents that may be posted on the CADasBuilt Site from time to time are hereby expressly incorporated herein by reference. CADasBuilt reserve the right, in CADasBuilt sole discretion, to make changes or revisions to these Terms of Use at any time and for any grounds.

The rights granted to you under these Terms of Use are subject to the following limitations: 

(a) you will not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit the Sites or Services;

(b) you will not modify, make derivative works of, disassemble, reverse compile, or reverse engineer any part of the CADasBuilt Site or Services except as may be expressly permitted in writing; 

(c) you will not access the CADasBuilt Site or Services in order to build a similar or competitive service; and 

(d) except as expressly stated herein, no part of the CADasBuilt Site or Services may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means. Any future release, update, or other addition to functionality of the CADasBuilt Site or Services will be subject to the terms of these Terms of Use. 

CADasBuilt reserves the right, at any time, to modify, suspend, or discontinue the CADasBuilt Site or Services or any part thereof with or without notice. You agree that the CADasBuilt will not be liable to you or to any third party for any modification, suspension, or discontinuance of the CADasBuilt Site or Services or any part thereof, except and if otherwise expressly set forth. 

You herby agree that CADasBuilt will have no obligation to provide you with any support in connection with the CADasBuilt site or Services.

Intellectual Property Rights

Unless otherwise indicated, the CADasBuilt Site is CADasBuilt property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, employees, agents, suppliers and any graphics on the CADasBuilt Site and the trademarks, service marks, and logos contained therein are owned or controlled by CADasBuilt or licensed to CADasBuilt, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the Israeli Judicial system.

The Content and the Marks are provided on the CADasBuilt Site “AS IS” for your information and personal use only. Except as expressly provided under these Terms of Use, no part of the CADasBuilt Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose, without CADasBuilt prior written consent.

CADasBuilt website is independent of Autodesk inc. and is not sponsored, endorsed or affiliated with Autodesk inc. Autodesk AutoCAD is a product that is wholly owned by Autodesk. Please refer to Autodesk's websites for specific trademark and copyright information. Please visit www.autodesk.com to buy AutoCAD or to receive further information. 

Excluding the above, all the intellectual property rights, including copyrights, patents, trademarks, and trade secrets in the CADasBuilt site are owned by the CADasBuilt or the its’s licensors. The use of the CADasBuilt Site and Services does not transfer to you or any third party any rights including intellectual property rights. CADasBuilt and its suppliers reserve all rights not granted explicitly in these Terms of Use.

User Representation

By using this CADasBuilt you declare as follows:

(1) all registration information you submit will be correct, current, and complete.

(2) you will maintain the accuracy of such information and update your registration information as needed.

(3) you have the legal capacity, and agree to meet the terms stipulated in these Terms of Use.

(4) you are not under the age of 18.

(5) You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental authorization to use the CADasBuilt site.

(6) you will not use the CADasBuilt Site for any illegal or unauthorized purpose.

(7) your use of the CADasBuilt Site will not violate any applicable law or regulation.

(8) you will not access the CADasBuilt Site through automated or non-human means, i.e AI, bot, script, or otherwise.

If you provide any information that is incorrect, not current, or incomplete, CADasBuilt have the right to suspend or terminate your account and refuse  to allow you any use of the CADasBuilt Site.

Services 

CADasBuilt offers licenses for free products, educational products, Student License, Commercial License, and University Multi-User License (hereinafter: “Services”).

Free Products

Our Free Educational Use License is specifically designed for academic purposes. Under this license, CADasBuilt's free products can be utilized in educational settings, including classroom activities, academic projects, and other learning initiatives. When using a product, you are required to grant full credit to CADasBuilt, with an active link for online versions. Additionally, if a project using our product is showcased on social media, you must credit CADasBuilt with an active tag to our profile. Please note that commercial use of these products under this license is strictly prohibited.

Student License 

Products labeled "Student License" are exclusively for student use in academic settings. These products are intended to support educational development and must not be employed for any commercial purposes.

Commercial License

With the purchase of a Commercial License, you are authorized to use the product in commercial projects without the need to attribute CADasBuilt. However, the standard prohibitions on reproduction, distribution, and resale, as detailed in the "Strictly Forbidden" section, remain applicable.

University Multi-User License

The University Multi-User License is tailored for educational institutions, allowing up to 30 users, including students and teachers, to use our products for academic purposes. This license facilitates the use of our products in educational environments, such as classroom learning, academic research, and student projects. Redistribution or commercial use of these products under this license is not allowed.

PAID SERVICES and PAYMENTS

Paid Services

At this registration of a user account is free of charge and access to the basic services is provided free of charge. Without derogating the above, CADasBuilt may from time to time at its sole discretion decide to charge for certain elements of the Services and/or introduce or apply further fees and charges for certain features or services, the "Paid Services". 

In case CADasBuilt decides to so, it will make it clear to you which of the Services are free, and which are Paid Services. If you purchase any of our Paid Services, you agree to pay us all applicable fees net of taxes or withholding. In such case, you may also be required to agree to specific terms and conditions. You acknowledge and consent that failure to pay such fees will result in termination of the Paid Services.

Nothing in the above shall suggest or oblige CADasBuilt in any way to provide Paid Services which CADasBuilt may or may not introduce.

Payments

You expressly authorize CADasBuilt to charge you for Paid Services purchased, charges for use of the same and any applicable taxes. You agree to reimburse CADasBuilt, if applicable, for all collection costs and interest for any overdue amounts. If the credit or payment card you provide expires and or you do not update your payment details or cancel your Paid Services, you authorize us to suspend your access to the applicable Paid Services until your payment details have been updated. After such suspension, you agree that CADasBuilt may re-attempt payment processing upon receiving updated billing details.

Termination of Use

These Terms enter into force on the date you first access the website and will continue to be in force until terminated by CADasBuilt or by yourself as set below. Upon termination of these Terms for any reason, you must immediately cease using the Services.

If you want to terminate these Terms you may do so by providing notice to CADasBuilt. You may stop using the Services at any time without giving notice to CADasBuilt.

CADasBuilt may, at its sole discretion, at any time and for any reason, including a period of account inactivity, terminate these Terms and or your use of the Services and or suspend or terminate your User Account.

In the event of termination, your Account will be disabled, and you may not be granted access to your account or any files or other content contained in your account even though some copies of information may remain in CADasBuilt system.

Links to Third Party: Vendors/ Creators

In case CADasBuilt Site provides links from the CADasBuilt Site to any third-party platform or permits any third party to sell from the CADasBuilt Site, you acknowledge and agree that CADasBuilt makes no guarantee of any kind, express or implied, and accepts no responsibility for any content or practices of such third parties or their platforms. 

CADasBuilt can not guarantee or monitor that the third parties' products that are offered by the CADasBuilt site do not contradict any copyright or other intellectual property rights of another party and the CADasBuilt site has no legal responsibility to copyright or other intellectual property claims of any third party regarding a sale that was made using the CADasBuilt site or to any product of a third party that was sold by using the services of the CADasBuilt site. Products of third-party sellers/vendors/creators participate in deals, campaigns, promotions according to the CADasBuilt discretion. 

CADasBuilt cooperates with sellers/vendors/creators to establish the price for each product on CADasBuilt platform. Without derogating the above, product's price, discounts and changes in pricing over time are solely determined by CADasBuilt.

CADasBuilt has no control over, and undertakes no responsibility for, the content, accuracy, privacy policies, intellectual property rights, practices or opinions expressed in any Third Party Services which are offered by the CADasBuilt site. In addition, CADasBuilt will not and cannot monitor, verify, censor or edit the content of any Third Party Service. By using the Services, you expressly relieve and hold harmless CADasBuilt from any and all liability arising from your use of any Third Party Services.

In order to download or use the free products displayed in this CADasBuilt site, you undertake to give full credit to designer/vendors each time you use their product and also mention the CADasBuilt site address: cadasbuilt.com.

Warranties and Disclaimers

CADasBuilt make, and you receive, no warranties, representations, undertakings, or guarantees of any kind, express or implied, oral or written, including any implied warranties of merchantability. 

Your use of the CADasBuilt website is at your own risk. The CADasBuilt Site is provided by CADasBuilt "as is" without any guarantee, either express, implied, statutory or otherwise. 

CADasBuilt expressly rejects any and all warranties of any kind, expressed or implied, to each and any service available from the CADasBuilt Site, including, but not limited to implied warranties for a particular purpose, non-infringement, and any other warranty that might arise under any law. 

Without limiting the above, CADasBuilt makes no guarantee that: (i) the CADasBuilt Site will meet your requirements; (ii) access to the CADasBuilt Site will be uninterrupted; (iii) the quality of the CADasBuilt Site will meet your expectations; and (iv) any errors or defects in the CADasBuilt site, services or materials will be corrected (v) any claim of a third party regarding intellectual property rights against CADasBuilt site users including any claim against CADasBuilt client regarding a use of a product that was sold by the CADasBuilt site to CADasBuilt client. CADasBuilt makes no representations or warranties that the CADasBuilt Site will be permitted in your jurisdiction, that any of Your Content submitted by you will be available through the CADasBuilt Site or will be stored by the CADasBuilt Site, that the CADasBuilt Site will meet your needs, or that CADasBuilt will continue to support any feature of the CADasBuilt Site.

Limitations on Liability

CADasBuilt its licensors or suppliers have no liability both directly or indirectly for any incidental, special, indirect, consequential, or punitive damages; loss of profits or revenue; business interruption or loss of use; cost of procurement of substitute goods or services or other cover; failure of, or defects in, the output; loss, corruption, or deletion of, or failure to delete, data or your content; or damages resulting from force majeure. 

The overall liability of CADasBuilt and its licensors and suppliers will in no event exceed the greater of (a) the amount paid or payable by you for the offering in the one-year period before the events or circumstances giving rise to the liability first occurred, or (b) NIS1,800. 

The limitations on liability in these terms will apply to the maximum extent permitted by applicable law to any damages or other liability, however caused and regardless of the theory of liability, whether based on contract, tort (including negligence and strict liability), indemnification, recourse, statute, or otherwise, and even if CADasBuilt has been informed of the possibility of the liability or the liability is otherwise foreseeable, and regardless of whether the limited remedies in these terms fail of their essential purpose.

Refund policy

CADasBuilt offer digital products. You hereby agree to our refund policy according to the exclusive jurisdiction, laws, refund policies of the state of Israel. 

Please make sure that you've carefully read the products' description before making a purchase. As the Website offers non-tangible, irrevocable goods we do not provide refunds after the digital product is purchased, which you acknowledge prior to purchasing any product on the Website.

CADasBuilt Privacy Policy applies to use of CADasBuilt website, and its terms are made a part of these Terms of Use. CADasBuilt is committed to keeping your data confidential. CADasBuilt does all in its power to prevent data theft and unauthorized access by implementing the latest technologies and software, which help CADasBuilt safeguard all the data collected online by CADasBuilt.

All messages, agreements, and other communications CADasBuilt send to you via email meet the legal requirements that such communications be in writing.

You agree that CADasBuilt will communicate with you inter alia by posting news and messages on CADasBuilt website and by emailing. You agree to maintain your contact information current. Entire Agreement 

These Terms of Use, and any supplemental terms incorporated, constitute the entire agreement between you and CADasBuilt regarding your use of the CADasBuilt Site and Services. RS Studio failure to exercise or enforce any provision or right under these Terms of Use shall not constitute as a waiver of such provision or right.

If any provision under these Terms of Use is, for any reason, found to be invalid or unenforceable, the other provisions under these Terms of Use will be unaffected and the invalid or unenforceable provision shall be considered modified as valid and enforceable to the maximum degree acceptable.  

Governing Law and Jurisdiction

These Terms of Use shall be governed by the laws of the State of Israel. Any action or proceeding regarding to a disagreement or a claim which occurs as a result or in regard to these Terms of Use must be brought to the relevant Court in Tel Aviv and each party irrevocably agrees to the exclusive jurisdiction of any such Court in any such action or proceeding. Notwithstanding anything to the contrary, CADasBuilt may seek injunctive relief in any Court with jurisdiction to protect its intellectual property rights or confidential or proprietary information.
